Acceptance of Terms

By accessing, browsing, or utilizing iFileSender ("we", "us", "our", or the "Service"), accessible at ifilesender.com, you confirm that you have read, understood, and agreed to be legally bound by these Terms and Conditions and our Privacy Policy.

If you do not agree to all terms and conditions set forth herein, you must immediately cease using the Service. You must be at least 13 years old (or the legal age of digital consent in your jurisdiction) to use iFileSender.

Description of the Service and Zero-Storage Architecture

iFileSender provides a web-based, peer-to-peer file transfer coordination utility that facilitates direct data communication between two user-controlled web browsers using WebRTC technology.

Our servers operate solely as an ephemeral signaling conduit to establish the initial peer-to-peer connection. iFileSender does not host, upload, inspect, cache, or store user files. All file transmissions occur directly between the participating client devices over encrypted peer channels.

User Responsibilities and Acceptable Use Policy

You maintain complete ownership of and bear sole legal responsibility for all files, data, and communications transmitted through your use of the Service. Because iFileSender operates as a blind, zero-storage peer-to-peer conduit, we do not screen or moderate transferred content.

You agree NOT to use iFileSender to transfer, distribute, or coordinate the transmission of:

  • Any content that infringes upon copyrights, patents, trademarks, trade secrets, or proprietary rights of any third party without express legal authorization.
  • Child Sexual Abuse Material (CSAM), non-consensual intimate imagery, or content that promotes human exploitation, terrorism, or violence.
  • Malicious software, viruses, trojan horses, ransomware, keyloggers, rootkits, spyware, or destructive scripts.
  • Files intended to harass, stalk, defraud, extort, impersonate, or violate the privacy rights of any individual.
  • Any material that violates applicable local, state, national, or international laws, including export control and trade sanctions regulations.

You further agree not to interfere with, disrupt, reverse engineer, probe, or launch denial-of-service attacks against our signaling servers or network infrastructure.

Third-Party Advertisements, Sponsored Content, and External Links

To maintain iFileSender as a free service without subscription fees, the website displays third-party advertisements and commercial listings (including Google AdSense display ads, auto ads, and programmatic advertising units).

  • Independent Advertisers: Third-party advertisements displayed on the Service are generated and served by third-party ad networks. iFileSender does not review, verify, endorse, sponsor, or guarantee the claims, offers, goods, or services presented in any advertisement.
  • Dealings with Advertisers: Any interaction, correspondence, or business transaction with third-party advertisers found on or through iFileSender—including payment, delivery of goods, and warranties—is solely between you and the respective advertiser.
  • Zero Liability for Ad Interactions: iFileSender and its operators shall not be responsible or liable for any loss, damage, misrepresentation, or legal issue arising from your interactions with third-party advertisers or reliance on advertising materials.
  • External Hyperlinks: The Service may contain links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or business practices of external third-party sites.

Intellectual Property and Proprietary Rights

The iFileSender website, including its source code, visual interface, graphic design, layout, styling, text, documentation, logos, and service marks, is the exclusive intellectual property of iFileSender and is protected by international copyright, trademark, and trade dress laws.

We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the web application for personal or internal business file transfers in accordance with these Terms.

Third-Party Trademarks and Non-Affiliation Notice

Trademark Fair-Use Notice: Apple, Mac, macOS, iPhone, iPad, iOS, Safari, and AirDrop are registered trademarks of Apple Inc. Android, Google, Google Chrome, and Quick Share are registered trademarks of Google LLC. Microsoft, Windows, and Microsoft Edge are registered trademarks of Microsoft Corporation.

Any references to these third-party platforms, hardware devices, operating systems, or trademarks on iFileSender are made strictly for descriptive purposes to inform users about device compatibility, cross-platform interoperability, and transfer instructions.

iFileSender is an independent web application and is not sponsored by, endorsed by, affiliated with, or associated with Apple Inc., Google LLC, or Microsoft Corporation.

DMCA and Copyright Infringement Claims

iFileSender respects the intellectual property rights of creators. As described in our technical architecture, iFileSender does not host, store, index, or possess files transferred between users. Because all transfers are peer-to-peer and encrypted, we have no technical ability to access, inspect, or delete files transmitted between devices.

If you believe that any web content, text, or imagery hosted directly on the iFileSender website infringes upon your copyright, you may submit a formal notification pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512) via our Contact Page.

Disclaimer of Warranties ("As-Is" and "As-Available")

The Service is provided strictly on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, whether express, statutory, or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. We do not warrant that file transfers will be uninterrupted, error-free, immune from network packet loss, or fully compatible with every browser version, router, or firewall configuration.

Limitation of Liability

To the maximum extent permitted by applicable law in your jurisdiction, in no event shall iFileSender, its developers, operators, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages whatsoever, including damages for loss of files, data corruption, transmission failures, device malfunction, lost profits, or business interruption. Users are solely responsible for maintaining independent, verified backups of all original files before initiating transfers.

To the extent permitted by law, our total cumulative liability to you for all claims arising out of these Terms or use of the Service shall not exceed $0.00.

Indemnification

You agree to defend, indemnify, and hold harmless iFileSender, its operators, contributors, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to files or data transmitted by you using the Service, your violation of these Terms, or your infringement of any intellectual property, privacy, or other rights of a third party.

Governing Law, Modifications, and Inquiries
